The Green Scorpions Criminal Case against EnviroServ and senior directors has been adjourned until the 30th November 2018. EnviroServs application to the High Court challenging the constitutionality of the provisions on NEMA are to be filed by the end of May 2018.
The WHO odour threshold for H2S was equalled or exceeded on eighty four occasions during the month of February 2018. This equates to 42 hours in the month of February 2018.
The legal position: status and update. There are currently 5 proceedings pending. They are: (i) The civil action (i.e. summons and particulars of claim) in which the UHA NPC seeks, inter alia, a final interdict against EnviroServ (“Es”) operating at the site, if by the time the action is heard
